How should I prepare for an initial consultation with a family lawyer?

Before your consultation, it’s helpful to gather any relevant documents, such as financial records, tax returns, information about assets and debts, and any existing court orders or agreements.

You should also be prepared to discuss the details of your situation openly, even if some topics feel personal. Family law matters often involve sensitive issues, and having a clear picture helps your attorney provide more accurate guidance.

We also suggest that you write down any questions you have in advance. That way, you can make the most of your time and leave with a better understanding of your options.

How long does a divorce take in Spokane?

In Washington, a divorce cannot be finalized until at least 90 days after the petition is filed and served. This is a mandatory waiting period—and the shortest possible timeframe to get divorced, even if you and your spouse agree on everything.

However, many cases take longer, especially when there are disagreements over issues like child custody, support, or property division. More complex cases or those that go to court may take several months or more to resolve, while uncontested divorces can often be completed more quickly.

How is child custody decided in Washington?

In Washington, these decisions are based on the best interests of the child. Rather than using traditional “custody” and “visitation” labels, courts rely on a parenting plan that outlines each parent’s role. This includes the child’s residential schedule, or where the child will live, as well as how major decisions will be made.

In some cases, parents are able to agree on a parenting plan, which a judge will typically approve. If an agreement cannot be reached, the court will decide the terms of the plan.

Judges consider factors such as the strength of each parent’s relationship with the child, the child’s needs, and each parent’s work schedule and ability to provide a stable environment. The goal is to create an arrangement that supports the child’s well-being while maintaining meaningful relationships with both parents whenever possible.

How is property divided in a Spokane divorce?

Washington is a community property state, which means most assets and debts acquired during the marriage are considered jointly owned. However, this does not always mean everything is split evenly. Property that one spouse owned before the marriage or received as a gift or inheritance may be considered separate property and treated differently.

Courts aim for a fair and equitable division based on the circumstances of each case. Factors such as the length of the marriage, each spouse’s financial situation, and the nature of the property may all be considered.
